1. Who we are and how you agree

Vision Movie and Vision Movie are operated by Malcolm Hedley Cohan (ABN 40 327 342 135), trading as Vision Movie, of 189 Federal Drive, Federal NSW 2480, Australia ("we", "us", "our"). "You" means the person who uses the site or the app at visionmovie.app (the "Service").

You agree to these terms when you do any of the following: tick the box on the first page of the app that says you accept them; create an account; or pay for anything. If you do not agree, do not use the Service. These terms, our Privacy Policy, and any notices we show you inside the app together form the agreement between us.

2. What the service is

The Service is creative software. It helps you make a short vertical video (a "Vision Movie") from photographs you supply, answers you write to a set of questions, captions and scene descriptions you edit and approve, and a music track. The images and video clips are generated by artificial-intelligence models run by third-party providers on our instructions, then assembled by us into a finished file.

The Service is a tool for imagination, motivation and self-expression. It is not a medical, psychological, scientific or financial service, and it makes no representation about your health, your lifespan, your appearance, or the future of medicine. See section 12.

Prices are in US dollars and are shown before you pay.

Gift codes sold before 30 September 2026 can still be redeemed on the first page of the app.

Your Vision Movie is paid for when you press Pay US$49.95 and start on the first page of the app. Nothing else is charged unless you choose it. Each purchase is a one-off; there is no recurring subscription.

If generation fails. Because the Service is built on AI models that sometimes refuse or fail, we cannot promise that every scene you describe can be made. If the movie build fails after three attempts on our side, we refund the purchase automatically. If a single scene cannot be generated because of the models' own content filters, we will tell you and ask you to change it; that is not a failure on our side.

Your consumer rights. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. If you are a consumer in another country, you may have similar rights under your local law. Nothing in these terms limits those rights. Beyond them, and beyond the automatic refund above, purchases are not refundable once generation has begun, because the third-party model costs are incurred immediately.

Starting straight away (European Union and United Kingdom). If you live in the European Union or the United Kingdom, you normally have 14 days to change your mind about something you buy online. Your movie starts generating as soon as you pay, because you ask it to. By ticking the terms box on the first page of the app and paying, you ask us to begin immediately, and you accept that you lose that right to change your mind once generation has begun. Your other rights, including the automatic refund above, are not affected.

5. Your content and your responsibility

"Your Content" means everything you put into the Service and everything it makes for you from that: your photographs, your answers, your captions, your scene descriptions and prompts, any reference images or music you upload, your choice of every candidate image, your approval of every scene, and the drafts and finished movie.

You are the author and the director. The Service does not decide what your movie shows. You write the answers; you edit each caption and each description; you choose which of the generated images to use; and you press Approve on every scene before any video is made. We do not read, review, endorse or adopt your content, and we are not its publisher. We provide the tools. You supply the vision, and you carry the responsibility for it.

6. Content rules

These rules exist because a Vision Movie is a realistic film of a real person, and realistic films can be used to hurt people. You may not use the Service to create, request, upload, approve or share anything that:

  1. Involves a child. No photographs of anyone under 18 anywhere in the Service, for any purpose, including your own children. No scene that depicts a minor.
  2. Depicts another real person without their consent. Your ideal self is the only real person your movie may portray. Named celebrities, public figures, people you know, and anyone recognisable from a reference image may not be shown, and may never be shown in a sexual, violent, humiliating, deceptive or defamatory way, whether or not they consented. Descriptions of named people are automatically rewritten as look-alikes before generation (see section 7).
  3. Is sexual. No nudity, no sexual acts, no sexualised posing, and no "undressing" of any image.
  4. Is violent, cruel or extremist. No graphic violence, torture, gore, self-harm, weapons used against people, terrorism, or content that praises or promotes any of these.
  5. Is hateful or harassing. No content that attacks, threatens, demeans or incites hatred against any person or group on the basis of race, ethnicity, national origin, religion, disability, age, sex, sexual orientation, gender identity or any other protected attribute; no bullying, stalking or intimidation of anyone.
  6. Is illegal or promotes crime. No content that depicts, plans, instructs or glorifies a crime, drug manufacture, fraud, or the evasion of law enforcement.
  7. Is deceptive. No movie presented as genuine footage of real events; no impersonation of any person, organisation or authority; no removal of the AI disclosure in section 8; no use of your movie in scams, disinformation or political manipulation.
  8. Infringes anyone's rights. No copyrighted music, characters, artwork or footage you do not have the right to use; no trademarks you do not own; no confidential information belonging to someone else.
  9. Attacks the Service. No attempts to bypass, probe or defeat our prompt rewriting or the providers' content filters; no automated access, scraping or bulk generation; no malware; no use of the Service to test or train other systems.

If you are unsure whether something is allowed, it probably is not. Ask us first at the address below.

7. How we enforce the rules

8. AI disclosure and labelling

Every Vision Movie is generated with AI. Exported movies close on a "visionmovie.app" card, and may carry embedded provenance data that identifies the file as AI-generated. You may not remove, hide, crop out or alter this disclosure. It exists so that viewers and platforms know the movie is a work of imagination; it is a disclosure of the tool used and is not an endorsement by us of anything the movie shows or says.

Most social platforms require AI-generated content to be labelled when posted. Following those rules is your responsibility.

9. Your movie and the licences around it

Your ownership. As between you and us, you own the finished Vision Movie and may use it for any lawful personal purpose: watch it, download it, share it, post it, put it on your website. Because it is generated by AI, copyright protection may be limited or unavailable in some countries; we make no promise about that.

Music. Tracks from our library are licensed to you only as part of your Vision Movie: you may post and share the movie with the track in it, but you may not extract the track, use it in another video, or distribute it on its own. The library is provided under licence from a music partner and is subject to that partner's terms, which we pass on to you.

Your licence to us. So that we can make your movie, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, transmit and modify your content, and to send the parts that are needed to the AI providers who generate your scenes. This licence lasts only as long as needed to provide the Service, keep the records described in section 7, and comply with law. We do not use your face, your writing or your movie to train AI models, and we do not show your movie to anyone unless you opt in to the gallery.

Help finishing your movie. Once your movie is paid for, a member of our team may open it to help you finish it: improving or replacing its pictures, video clips, prompts, captions and music, and exporting it. We do this at no charge to you, it never uses up your allowances, and it is covered by the licence above. Before we first change anything we keep a copy of your own version, and we will put it back if you ask.

Gallery. If you tick the gallery box, you additionally give us a worldwide, non-exclusive, royalty-free licence to display your movie on visionmovie.app and our social channels as an example of the Service, until you withdraw it. We moderate the gallery, and we may decline to feature any movie. Withdraw at any time by emailing us; we remove the movie within a reasonable time.

10. Our intellectual property and the Vision Movie method

Everything in the Service other than your content belongs to us or our licensors and is protected by copyright, trade mark and other laws. This includes the website and the app; the words, layout and design; the question set; the caption style and the scene structure; the prompts, workflows, model configurations and pipeline that turn your answers into a film (the "Vision Movie Method"); the hero film and all example movies; the music library; and the names Vision Movie and Vision Movie and their logos (the "Marks").

We give you a personal, non-transferable, revocable licence to use the Service to make your own Vision Movie in accordance with these terms. Nothing else is licensed. In particular you must not:

These restrictions survive the end of your use of the Service. They do not stop you using general skills or knowledge that you already had or that are publicly available, and they do not prevent conduct that the law allows regardless of contract.

Feedback. If you send us ideas or suggestions about the Service, you agree we may use them without payment or attribution, and you do not gain any rights in the Service as a result.

11. Sharing and third-party platforms

When you post your movie on YouTube, TikTok, Instagram, Facebook, X or anywhere else, you do so under that platform's rules, and the platform, not us, decides what happens to it there. Some platforms use automated systems that may claim or restrict videos containing licensed music; we work with our music partner to reduce this, but we cannot control it.

13. Limits on our liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, and nothing limits our liability for death or personal injury caused by our negligence, or for fraud.

Subject to that:

14. Your release and indemnity

Release. To the extent the law allows, you release us, our directors, staff and contractors from any claim, loss or liability arising from: (a) the content of your movie and how you use it; (b) how any other person uses, shares, alters or reacts to your movie; (c) any decision you make about your health, body, finances or life in reliance on the Service; and (d) your breach of these terms.

Indemnity. If someone else brings a claim against us, or we suffer a loss, fine or cost, because your content broke the Content Rules, infringed someone's rights, or was used to deceive or harm someone, or because you otherwise breached these terms, you agree to compensate us for the reasonable losses and costs we incur as a direct result, including reasonable legal costs. This indemnity is limited to loss caused by your breach, does not apply to the extent we caused the loss ourselves, and does not affect any right you have under the Australian Consumer Law.

If you believe a Vision Movie shows you without your consent, shows a child, infringes your rights, or otherwise breaks the Content Rules, email us at the address below with the link and a short description. We act on such reports promptly, usually within two business days, and we may remove the content while we look into it. We also comply with removal notices from the eSafety Commissioner and with court orders.

17. Changes to these terms

We may update these terms as the Service changes or the law changes. We will show the date of the latest version below, and for significant changes we will tell you inside the app or by email before they apply to you. If you keep using the Service after a change takes effect, you accept the change. Purchases already made are governed by the terms in force when you made them.

18. Governing law and disputes

These terms are governed by the laws of New South Wales, Australia, and you agree that the courts of that State and the Commonwealth of Australia may hear any dispute. If you are a consumer outside Australia, you keep any right to bring a claim in your own country under laws that cannot be excluded. Before either of us starts a claim, we agree to try to resolve the matter by talking: write to us, and we will reply within ten business days.

If any part of these terms is found to be unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it. These terms are personal to you; you may not transfer them. We may transfer our rights to a successor business on notice to you.
